Dotti Nation Terms and Conditions
Welcome to Dotti Nation.
Dotti Nation is an interactive web portal that allows members to upload, view, vote and comment on fashion designs and outfits presented on the website (“the service”).
By using the service you agree to be bound by the following terms and conditions:
1. Capacity and Access
1.1 To use the service you must be over the age of 18 years, or if you are under the age of 18 you must obtain a parent or guardian’s consent.
By accessing the service you warrant that you are over 18 or have obtained a parent or guardian’s consent. Dotti accepts no responsibility for users who have falsely provided information to access this service.
1.2 You must be a registered user of Facebook to gain access to this service. To login to the service you must sign in with your Facebook user name and password.
1.3 By accessing and using the service you agree and warrant to Dotti that you will comply with the Facebook terms of use.
2. Privacy
2.1 Your privacy is important to us. Dotti has its own Privacy Policy which explains how we collect and use personal information you provide to us. Please read the Privacy Policy and also the Dotti Nation Privacy Statement below.
2.2 Dotti Nation Privacy Statement
2.2.1 The first time you login to the service, you will be asked to confirm your email address, provide your full name, date of birth and the state you live in. The personal information you provide when you login will be used for the purpose of:
a) Enabling Dotti to record your details as a member of Dotti Nation;
b) Enabling you to participate in the service, including without limitation interacting with your Facebook profile;
c) Sending you information about Dotti if you subscribe to receive this information.
2.2.2 Dotti may disclose your personal information to organisations which help Dotti support and maintain the service and may otherwise use and disclose your personal information as required or authorised by law.
2.2.4 If you do not provide the personal information requested by Dotti you will not be able to join or participate in Dotti Nation.

3. Content
3.1 Any text (including without limitation comments), photographs, drawings, sketches, images and other material (“Content”) you post to the service will automatically become owned by Dotti, and you hereby assign all intellectual property rights in the Content to Dotti.
3.2. You warrant and represent that all Content is original and free from any intellectual property claims.
3.3 You warrant and represent that all Content you post to the service does not infringe the intellectual property rights of any third party whatsoever.
3.4 You agree to indemnify Dotti against any loss, damage or claim made in relation to any breaches of intellectual property rights arising from the publication of the Content. This includes legal costs for defending any such action (on a solicitor-client basis).
3.5 Any Content you submit to the service must:
3.5.1 Not constitute unauthorised commercial communication (such as spam);
3.5.2 Not solicit login information, personal information or access to an account belonging to someone else;
3.5.3 Not bully, intimidate or harass any other users;
3.5.4 Not contain content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence;
3.5.5 Not develop or operate a third party application containing, or advertise or otherwise market alcohol-related or other mature content;
3.5.6 Not use the service to do anything unlawful, misleading, malicious, discriminatory or defamatory;
3.5.7 Not do anything that could disable or impair the proper working of the service; or
3.5.8 Not facilitate or encourage any violations of these terms and conditions.
3.6 Dotti reserves the right to remove immediately from the service any Content which Dotti deems in its sole discretion is contrary to clause 3.5, or is otherwise inappropriate for the Dotti website.
3.7 When you post any Content it will become available for everyone to see, including people who are not members of Dotti Nation.
3.8 Any unauthorized use of Content, comments on blogs or other information displayed publicly on the Dotti website will be dealt with by Dotti, in the appropriate manner, including but not limited to initiating legal proceedings.
4. Entry Requirements in relation to Design A Bits
Clauses 4 and 5 below relate to the ‘Design A Bits’ section of Dotti Nation. Design A Bits is a competition for members of Dotti Nation to submit Content which is judged by Dotti. You must be a member of Dotti Nation to participate in Design A Bits.
4.1 Judges will only consider Content if:
4.1.1 It is received by Dotti within the time specified on the Dotti website;
4.1.2 It is not larger than 10MB in size; and
4.1.3 It fulfils the brief published on the Dotti website.
4.2 Any Content you submit to Design A Bits will not be returned.
4.3 Dotti reserves the right not to publish the Content submitted or to remove the Content from the website at any time it chooses, without further notice to you.
4.4 Dotti will not accept responsibility or liability for:
4.4.1 Lost, misdirected or late entries; or
4.4.2 Technical malfunctions or problems arising from or associated with the use of the service.
4.5 Only residents of Australia and New Zealand are permitted to submit Content for consideration by the Judges. Content submitted by users living outside Australia and New Zealand will not be eligible for any prizes. If a winner is chosen that is not a resident of Australia or New Zealand, the winner will be immediately disqualified and another winner will be chosen at the discretion of the Judges.
5. Rules in relation to Design A Bits
5.1 Voting will take place during the times specified on the Dotti website only.
5.2 After consideration by the Judges, the winner will be notified by email. Dotti reserves the right not to award a winner in Dotti’s sole discretion.
5.3 If you are the winner, Dotti will award you a prize announced on the Dotti website.
5.5 Dotti in its sole discretion, is entitled to manufacture, reproduce, sell, advertise and market the Content submitted, commercially.
5.6 Dotti provides no guarantee that if you are the winner, the Content will be manufactured, reproduced, sold, advertised or marketed in any way whatsoever.
5.7 Dotti in its sole discretion may modify or adapt the Content you submit as it sees fit. Dotti may change prints, patterns and other elements in Dotti’s sole discretion.
5.7 You must sign any further documentation that may be required to allow Dotti full ownership and rights to the Content you submit. You irrevocably waive all moral rights in the Content that you submit.
5.8 The prize awarded is not exchangeable and cannot be redeemed for cash or credit.
5.9 The judges in their sole discretion will determine the winner.
5.11 You consent to Dotti publishing your name in association with the Content you submit, but without any obligation for Dotti to do so. You acknowledge and agree that Dotti may not attribute the Content to you.
5.12 If you are announced as the winner, you must obtain Dotti’s prior consent before publicising your winning to any person or entity. You must not falsely associate or represent to any other person that you are connected with Dotti.
5.13 If you do not satisfy these terms and conditions, forfeit the prize, or fails to claim the prize within the period notified to you by Dotti, Dotti is entitled to select a new winner, who will be notified by email.
6. Termination
6.1 If you breach any of these terms and conditions, Dotti can stop granting you access to the service. Dotti will notify you by email or at the next time you attempt to access the service.
6.2 You may choose to disconnect or disable access to the service at any time.
7. The Service
You use the service at your own risk. Dotti provides the service "as is" without any express or implied warranties including but not limited to implied warranties of merchantability, fitness for purpose and non-infringement. Dotti does not guarantee that the service will be safe or secure. Dotti is not responsible for the actions, content, information or data of third parties, and you release Dotti, its directors, officers, employees and agents from any claims and damages, known and unknown, arising out of or in any connected with any claim you have against any such third parties.
8. Intellectual property
8.1 All copyright, trade marks, designs ("intellectual property"), in and to the service including but not limited to the Content, compilation of Content and software are owned or licensed by Dotti.
8.2 You must not use, copy, adapt, modify or alter any intellectual property owned or licensed by Dotti in any way whatsoever.
9. Internet Delays
9.1 The service may be subject to limitation, delays and other problems inherent in the use of the internet and electronic communications. Dotti is not responsible for any delays, delivery failures or damage resulting from such problems.
9.2 Login to Facebook to access the service may be subject to limitation, delays and other problems inherent in the use of the internet and electronic communications. Dotti takes no responsibility for any delays, delivery failures or damage caused by Facebook in any way whatsoever.
10. General
10.2 These terms and conditions make up the entire agreement between you and Dotti in relation to the service and supersede any and all prior agreements.
10.3 If any portion of these terms and conditions is found to be unenforceable, the remaining portion will remain in full force.
10.4 Dotti reserves the right to modify, suspend or terminate the Service if it cannot be conducted in accordance with these terms and conditions, or due to circumstances beyond Dotti’s reasonable control.
10.5 Any dispute you may have in relation to these terms and conditions, must be made in writing and addressed to Dotti General Manager, at the address of Dotti set out in clause 10.7.
10. The laws of the state of Victoria, Australia apply to these terms and conditions. You submit to the exclusive jurisdiction of the Courts of the Commonwealth of Australia and Courts of Victoria.
